Making a claim of "copying" in itself is not illegal. Could be considered
"False Advertisement", if you really want to get into it. However, the
conversion is of the concept, rather than the image itself. That is where
it gets complicated. Technically, the character CONCEPT is being converted
into a 3D design, not the image itself. Now, if the IMAGE ITSELF were
converted (Such as a statue made with a precisely identical pose and
composition), then that would be a derivative work, and be a
problem. However reverse engineering the image (Pattern of pigments) to a
character concept (Purple Eyeshadow, skunk, these markings, etc) and then
using the not-copyrightable character concept to create a new work is okay.
Worst legality issue could be in the wording, and that's surmountable by
changing said wording, and showing that the original claim was never
actually done.
