They aren't. In fact, I challenge you to find a single instance of a
lawsuit filed over a "Copyrighted Character" by a company (Warner, Disney,
Fox, etc.)... Plenty of Trademark violations, however not copyright
violations. The trademarks HAVE to be registered, though, to be enforced,
and HAVE to be enforced to remain enforceable.
Although it may be noted that more often, the company will send a C&D to
the ISP rather than actually sue the fan artist.
Also be aware that if the "Fan Artist" takes a cell from a video, and
proceeds to "Modify it", then that is a derivative work, and as such, that
specific image is breaking the copyright of the original picture.
