Though I risk flamage for such, I shall attempt to field this one.
There were no claims (as far as I read anyways) from Jim that he
owned the concept of Tabitha. His claim was that he held the
*copyright* to the original *artwork* of Tabitha done by Des.
As was pointed out earlier in this thread, noone may copyright a
character *concept*, only the individual art renditions of said
concept can be copyright (copywritten?).
Character concepts *might* be trademarkable (Not sure on this as I
haven't done as much research into Trademark law as I have
Copyrights), but even then only when used for a legal business
entity, and only for said business purposes.
So, as far as my interpretation stands (And your interpretation may
differ, but I have done quite a lot of research into copyrights as
part of my writing), there would be no legal reason why V.Kyrie
cannot continue to draw her own artwork featuring the Tabitha
character.
Just my .02 credits. I am not a legal expert or professional, but as
stated I have done extensive research into copyright law where it
regards to character concepts.
