Penance is sort of on both sides of the law. What she's doing is obviously illegal, but there's really no way anyone could hold her captive against her will.
Caterwaul (and eventually, Lot Six) sometimes works with the police, and most of the time, their task is to capture the bad guy and bring him to the authorities. Sometimes they are hired to take someone down permanently. The rules of society in their world are different than ours, so it's not quite as shocking as you might think.
